Terms of Service
1. What the service is
The Fynamics Exam Portal is software that lets an organization — a school, college, coaching or training institute, or an individual educator — create question banks, schedule and run online exams, release results and issue certificates, and lets candidates take those exams. Fynamics provides the software. The organization decides what to examine, who may take an exam, and what its results mean.
2. Accounts and who is responsible for what
An organization's administrator is responsible for the accuracy of the organization's details, for the people it gives access to, and for keeping credentials confidential. Candidates are responsible for their own accounts and for taking exams honestly.
The organization decides why and how its candidates' data is used and is responsible for having any consent or notice the law requires for that, including verifiable parental or guardian consent where candidates are under 18. Fynamics processes that data on the organization's behalf to provide the service, as described in our Privacy Policy.
3. Acceptable use
You must not misuse the service: no attempts to access another organization's data, to interfere with the service or its security, to cheat or help others cheat in an exam, to upload unlawful content, or to use the service to send spam. We may suspend access that puts the service or other users at risk.
4. Plans, fees and taxes
The Starter plan is free, with monthly limits on candidate registrations and sessions shown on our Pricing page. Paid plans raise those limits and are sold for a monthly or annual term, paid in advance.
Prices exclude GST, which is added and shown on the tax invoice issued for every payment. Plans do not renew automatically; we email reminders before a term ends. Buying a different plan starts the new plan immediately and replaces the current one, without proration. When a term ends, the organization returns to the Starter limits — no data is deleted, and an exam already in progress is never interrupted.

5. Exam integrity features
Features such as fullscreen enforcement and violation logging are aids that help an organization run a fair exam. They are not a guarantee that no one can cheat, and the organization remains responsible for how it interprets and acts on them.
6. Availability and changes
We work to keep the service available but do not promise uninterrupted operation. We may improve, change or retire features, and will give reasonable notice of changes that materially reduce what a paid plan offers.
7. Ownership
The software and its branding belong to Fynamics. An organization keeps ownership of the content it uploads (questions, course material, logos) and of its candidates' results, and gives us the right to host and process them to run the service.
8. Liability
The service is provided “as is”. To the extent the law allows, Fynamics is not liable for indirect or consequential loss, and our total liability for any claim relating to the service is limited to the fees the organization paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
9. Ending use
An organization can stop using the service at any time; because plans do not auto-renew, there is nothing to cancel. We may suspend or end access for a serious or repeated breach of these terms. On request, we will help an organization export its data, subject to legal obligations to keep certain records.
10. Governing law and changes
These terms are governed by the laws of India, and the courts having jurisdiction over Fynamics Technologies's registered office have jurisdiction over disputes. We may update these terms; the date above shows the latest version, and continued use after a change means you accept it.
